HEROIC KIDS TERMS & CONDITIONS

Welcome to Heroic Kids
These Terms & Conditions (“Terms”) govern your use of the Heroic Kids website, application, games, parent/caregiver portal, content, subscriptions, and related services (collectively, the “Services”). By creating an account, purchasing a subscription, accessing, or using the Services, you agree to these Terms. If you do not agree, please do not use the Services.
If you are a parent or legal guardian registering an account for a child, you are agreeing to these Terms on your own behalf and, where legally permitted, on behalf of the child for whom you are authorizing use of the Services.
1. Who We Are
Heroic Kids is a child-safety education platform designed to help children develop practical skills for recognizing uncomfortable situations, making safer choices, setting boundaries, protecting their privacy, seeking help, and communicating with trusted adults.
For purposes of these Terms, “Heroic Kids,” “we,” “us,” and “our” refer to the company operating the Heroic Kids website, application, and related Services.

2. Eligibility and Parent/Guardian Responsibility
Heroic Kids is designed for families and children. A parent or legal guardian must establish and manage an account when required by the Services and applicable law.
Parents and guardians are responsible for supervising their child’s use of the Services in a manner appropriate to the child’s age, maturity, circumstances, and family safety plan.
By authorizing a child to use Heroic Kids, you represent that you are the child’s parent or legal guardian, or that you otherwise have lawful authority to provide that authorization.
3. Children’s Privacy and COPPA
Protecting children’s privacy is fundamental to Heroic Kids. We follow applicable requirements of the Children’s Online Privacy Protection Act (COPPA) and the FTC’s Children’s Online Privacy Protection Rule.
Our privacy practices are described in our Privacy Policy, which is incorporated into these Terms by reference.
We do not sell children’s personal information and do not use children’s personal information for targeted advertising. Where applicable law requires verifiable parental consent before collecting, using, or disclosing a child’s personal information, we will obtain that consent before doing so, subject to applicable legal exceptions.
Parents and guardians have rights concerning their child’s information, including rights to review and request deletion of personal information, as described in our Privacy Policy.
4. Parent Accounts
You agree to provide accurate and current information when creating an account and to keep your account information reasonably up to date.
You are responsible for maintaining the confidentiality of your account credentials and for activity occurring through your account. Please notify us promptly if you believe your account has been accessed without authorization.
5. Subscriptions, Fees, and Payments
Certain Heroic Kids Services may require a paid subscription or other fee. Prices, billing periods, renewal terms, and any applicable taxes will be presented at the time of purchase.
Unless otherwise stated at the time of purchase, subscriptions may automatically renew at the end of each billing period until canceled. You may cancel according to the cancellation instructions provided with your subscription.
We may change subscription prices in the future. If a price change affects an existing subscription, we will provide notice as required by applicable law before the change takes effect.
Refunds, if available, will be handled according to the refund terms presented at purchase or applicable law.
6. The Heroic Kids Safety Education Experience
Heroic Kids provides educational games, stories, activities, scenarios, resources, and other content intended to help children develop safety awareness, confidence, communication skills, boundary-setting skills, decision-making skills, and related protective skills.
The Services are educational in nature. They are designed to complement—not replace—appropriate parenting, supervision, professional advice, emergency services, law enforcement, medical care, mental-health services, child-protection services, or other resources that may be appropriate in a particular situation.
7. Important Safety Disclaimer
HEROIC KIDS CANNOT GUARANTEE THAT A CHILD WILL NEVER EXPERIENCE BULLYING, ABUSE, EXPLOITATION, GROOMING, TRAFFICKING, ASSAULT, ONLINE HARM, OR ANY OTHER DANGEROUS OR TRAUMATIC EVENT.
Our purpose is to give children practical skills and confidence that may help them recognize risk, make safer decisions, communicate with trusted adults, and seek help. No educational program, app, strategy, or safety plan can eliminate every risk.
Parents and guardians remain responsible for determining what safety measures are appropriate for their child and circumstances.
If a child is in immediate danger or needs urgent assistance, contact appropriate emergency services or a qualified professional rather than relying on Heroic Kids.
8. Parent and Caregiver Responsibilities
Parents and caregivers agree to:
Review the Services and resources as appropriate for their family;
Provide age-appropriate supervision and guidance;
Talk with their child about how to seek help from trusted adults;
Keep account credentials secure;
Provide accurate information necessary to manage the account;
Use the Services in compliance with applicable laws; and
Take appropriate action when a child reports a safety concern or appears to be in danger.
9. Acceptable Use
You may use the Services only for lawful, personal, educational, and family-related purposes consistent with these Terms.
You agree not to:
Use the Services for unlawful, fraudulent, abusive, or harmful purposes;
Attempt to gain unauthorized access to accounts, systems, or data;
Interfere with or disrupt the operation or security of the Services;
Copy, reproduce, modify, distribute, sell, lease, sublicense, or exploit Heroic Kids content except as expressly permitted;
Reverse engineer, decompile, disassemble, or attempt to derive source code from the Services except where such restriction is prohibited by law;
Remove copyright, trademark, or other proprietary notices;
Use automated systems to scrape or systematically collect content from the Services without written permission;
Impersonate another person or misrepresent your affiliation with Heroic Kids; or
Use the Services in a way that could reasonably harm a child, another user, or Heroic Kids.
10. Intellectual Property
The Services and their content—including software, games, stories, characters, graphics, illustrations, designs, text, videos, audio, trademarks, logos, interfaces, and other materials—are owned by or licensed to Heroic Kids and are protected by applicable intellectual-property laws.
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for their intended personal and non-commercial purpose, subject to these Terms.
You may not use Heroic Kids branding, characters, artwork, game content, or other proprietary materials to create competing products, commercial materials, derivative works, or other unauthorized uses.
11. Feedback
If you provide suggestions, ideas, comments, or other feedback about Heroic Kids, you grant us permission to use that feedback without restriction or compensation, provided that we do not use personal information in a manner inconsistent with our Privacy Policy or applicable law.
12. Third-Party Services
The Services may rely on or link to third-party services, including hosting, payment processing, analytics, authentication, communications, or other technology providers. Third-party services are subject to their own terms and policies.
We are not responsible for the availability, accuracy, security, or practices of third-party services except to the extent required by applicable law.
13. Availability and Changes to the Services
We work hard to keep Heroic Kids available and useful, but we do not guarantee that the Services will always be uninterrupted, error-free, or available at every time or on every device.
We may modify, update, suspend, or discontinue portions of the Services from time to time. If a change materially affects a paid service, we will provide notice when required by applicable law.
14. Account Suspension and Termination
We may suspend or terminate an account or access to the Services if we reasonably believe that these Terms have been violated, the Services are being misused, payment obligations are not met, or suspension is necessary to protect users, children, the Services, or our legal rights.
You may stop using the Services at any time. Account deletion and deletion of children’s personal information are addressed in our Privacy Policy and applicable law.
15. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. HEROIC KIDS DISCLAIMS WARRANTIES NOT EXPRESSLY PROVIDED IN THESE TERMS, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE EXTENT PERMITTED BY LAW.
Nothing in these Terms is intended to exclude or limit any warranty, right, or remedy that cannot lawfully be excluded or limited.
16. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HEROIC KIDS AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO THE SERVICES.
To the maximum extent permitted by law, Heroic Kids’ total liability arising out of or relating to the Services will be limited to the amount you paid to Heroic Kids for the Services during the twelve (12) months preceding the event giving rise to the claim, unless applicable law requires a different limitation.
Nothing in these Terms limits liability that cannot legally be limited or excluded.
17. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Heroic Kids and its owners, officers, employees, contractors, licensors, and service providers from claims, liabilities, damages, losses, and expenses arising out of your misuse of the Services, your violation of these Terms, or your violation of applicable law or another person’s rights.
18. Dispute Resolution and Governing Law
These Terms will be governed by the laws of the State of Delaware, without regard to conflict-of-law principles, except to the extent federal law or applicable consumer-protection law provides otherwise.
Before initiating formal legal proceedings, we encourage you to contact us so that we can attempt to resolve the issue informally.
19. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will provide notice as required by applicable law. The updated Terms will become effective on the date stated in the revised Terms unless otherwise required by law.
Your continued use of the Services after the effective date of updated Terms constitutes acceptance of the revised Terms to the extent permitted by law.
20. Severability
If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the extent permitted by law.
21. Entire Agreement
These Terms, together with the Heroic Kids Privacy Policy and any additional terms expressly incorporated into the Services, constitute the agreement between you and Heroic Kids concerning your use of the Services, except where a separate written agreement applies.

We created Heroic Kids because we believe children can learn skills that help them become more confident, capable, and prepared—and parents deserve tools that help them have those conversations without living in fear.
We cannot promise that bad things will never happen. What we can promise is that we will continue working to build thoughtful, age-appropriate safety education that helps children develop the knowledge and confidence to recognize risk, protect their boundaries, and reach out for help.
